Private Vocational Institution compliance orders

The Director of the Private Vocational Institutions Branch can take action against registered Private Vocational Institutions not operating their business in accordance with the law, as well as unregistered institutions operating unlawfully.

Overview

The Minister of Advanced Education and Training must appoint a person as the director of private vocational institutions to administer the Private Vocational Institutions Act and its regulation.

The minister may appoint any person as an inspector for the purpose of administering and enforcing this Act.

Registration Required

A person must not operate, or hold themselves out as operating, a private vocational institution unless the person is registered. Unregistered institutions are in violation of the Private Vocational Institutions Act.

A private vocational institution must not provide a program of instruction unless the program is approved by the director. If a program is offered by an unregistered institution, that is also a violation of the act.

Compliance and enforcement actions

An inspector may issue an order if the inspector has reasonable grounds to believe that a person has contravened or failed to comply with the Private Vocational Institutions Act. The director may issue a notice in writing requiring a person to pay an administrative penalty if they fail to comply with an order.

The director may publicly report details of orders and administrative penalties made under the Private Vocational Institutions Act. This disclosure may include personal information.
